Fulton County Strikes Back at FBI Over Seizure of 2020 Election Documents

Fulton County leadership is launching a major legal counterattack against federal authorities this week. Officials announced plans to file an emergency motion in federal court on Monday to challenge the FBI’s recent seizure of 2020 election records. This aggressive move aims to limit the scope of the federal warrant that allowed agents to raid county offices last week.

The motion seeks an immediate court order mandating the return of all property taken during the raid. County attorneys argue the seizure was unlawful and violated previous judicial boundaries regarding sensitive election materials. This escalation marks a significant flashpoint between local Georgia officials and the Department of Justice regarding the handling of the 2020 presidential election ballots.

Commissioner Arrington Leads Legal Charge

Fulton County Commissioner Marvin Arrington Jr. is spearheading the response to what he describes as federal overreach. He stated that the county intends to fight the retention of the documents vigorously in court. The core of the dispute revolves around the nature of the materials taken by federal agents.

“The FBI needs to explain why they took original documents including ballots,” Arrington said in a statement to the press.

He argued that the federal agents should have only sought copies of the records. Arrington referenced a previous ruling in a related civil case which explicitly protected the original physical ballots from being removed or handled in this manner.

According to county officials, the federal warrant was executed in a way that bypassed established legal protections. The legal team insists that the original ballots are critical state records that should remain in county custody.

Circumventing Federal Judge Orders

The legal strategy focuses on a potential conflict between the new criminal warrant and prior orders from U.S. District Judge Thomas W. Thrash. Judge Thrash had previously presided over civil litigation regarding these election materials. In those proceedings, he restricted access to the physical records to preserve their integrity.

Arrington criticized the Department of Justice for essentially ignoring Judge Thrash’s authority. He suggested the raid was a calculated maneuver to get around the judge’s earlier denial.

“The judge in that case told them that they could not get the records,” Arrington explained. “So instead of them complying with that order, they did an end run and circumvented the judge’s order.”

Legal experts suggest this clash could lead to a significant jurisdictional showdown. The court must now decide if a criminal warrant supersedes a civil protective order in this specific context.

Arrington added, “I can’t imagine that Judge Thrash will be happy about the fact that they did this after he said no.”

DOJ Escalates Election Integrity Probe

The seizure involves approximately 700 boxes of documents related to the 2020 general election. FBI agents descended on the Fulton County elections offices last week to execute the warrant. This action signals a sharp escalation in the Department of Justice’s involvement in Georgia’s election administration.

The warrant was obtained by Thomas Albus. He is the U.S. Attorney based in St. Louis. The administration has designated Albus as the point-person for these election integrity cases.

His involvement suggests a widening scope of the federal investigation. It appears to be operating in tandem with inquiries pushed by the State Election Board. The board has recently revisited claims regarding the 2020 count despite multiple previous audits confirming the results.

The timing of the raid has also raised questions among observers. It occurred just days after a significant personnel change at the local FBI level.

  • Paul Brown, the special agent in charge of the Atlanta field office, resigned roughly a week before the raid.
  • The resignation was abrupt and unexplained.
  • Agents served the warrant shortly after his departure.

Political Tensions Reignite in Georgia

This legal battle reignites the intense political firestorm that has surrounded Fulton County since November 2020. The county has been the epicenter of conspiracy theories and repeatedly debunked claims of election fraud. State and federal investigations have cleared the county of wrongdoing multiple times over the last several years.

Georgia’s results were confirmed by three separate counts. This included a hand audit of every single ballot and a machine recount. None of these reviews found evidence of fraud that would have impacted the outcome.

Despite this, the Trump-aligned State Election Board has continued to pursue investigations. They are seeking to re-examine the processes used during that cycle.

Local officials worry this new federal seizure will further destabilize trust in the election system. They fear the physical removal of ballots breaks the chain of custody. The upcoming court hearing will determine if the FBI can keep the boxes or if they must return them to Fulton County immediately.
